Tribunal Dismisses LP’s Claim of Tinubu’s Undue Election

The Presidential Election Petitions Court on Wednesday dismissed the petitions of the Labour Party (LP) and its presidential candidate, Peter Obi, who had argued that President Bola Tinubu of the All Progressives Congress (APC) was not rightfully elected in the February 25, 2023 poll.

Regarding LP’s claim that Tinubu should not be declared the election winner due to his less than 25 percent vote share in the Federal Capital Territory (FCT) and his alleged lack of majority lawful votes, the Tribunal categorically rejected this argument as “ridiculous.”

Justice Haruna Tsammani, leading a five-member panel, considered constitutional principles emphasizing citizen equality.

The court cited Section 134 (2a) of the constitution, asserting unequivocally that achieving a 25 percent vote share in the FCT during a presidential election is not obligatory. Consequently, the court unequivocally declared LP’s petition lacking in merit.
